Dear Sir/Madam,
I sent an email to civstat_at_govmu.org on 16 March to ask about the
User Declaration Form for the National Identity Card. I did not
receive any reply to my email.
According to the Ministry of Technology, Communication and
Innovation, there is the following text in the User Declaration Form:
"I have no objection that my fingerprint minutiae be processed and
recorded for the purpose of producing my identity card. I understand that
this information will be erased permanently from the register once the
identity card has been printed."
I contacted the Data Protection Office to ask about the National
Identity Card. From what I understand, the consent of citizens is not
required if the data controller is complying with a legal obligation.
I would be grateful if the data controller for the National Identity
Card could explain the following:
(i) Is there a law or regulation for the collection and processing of
the fingerprint minutiae for the production of a National
Identity Card?
(ii) If the answer to (i) is yes, why is a citizen being required to state
that he/she has no objection to his/her fingerprint minutiae to be
processed and recorded?
(iii) Who is the data processor for the register?
(iv) Why is the citizen being asked to state that he/she
understands that the
fingerprint minutiae will be erased permanently from the
register? Isn't
it up to the data controller to state that given that the citizen does
not have any way to determine that the information will be erased
permanently?
